Pleadings and Motions
Pleadings
Rule 15(a) permits one amendment as a matter of course within twenty-one days after service or after a responsive pleading or motion. Later amendments require consent or leave, which courts freely give when justice requires.
Amendment after the scheduling order deadline requires good cause.
Alternative Names:
Amendment of Pleading, Amended Filing
Why it Matters?
The interaction between Rule 15's liberal standard and Rule 16's good cause requirement is what determines late amendments, since a scheduling order deadline converts the analysis from freely given to a showing of diligence. Opposing a post-deadline amendment on Rule 16 grounds is substantially more effective than arguing prejudice under Rule 15. Establishing when the party learned the facts supporting the amendment is the key inquiry.
