Coverage Investigation

Coverage investigation examines the policy against the claim: whether the insured qualifies, whether the loss falls within the insuring agreement, whether exclusions apply, and whether conditions have been satisfied.

It typically involves obtaining the complete certified policy with all endorsements.

Why it Matters?

Conducting the coverage investigation separately from the liability investigation is important because the two serve different masters. Information the insured provides to defend the claim may bear on coverage, and using it against the insured raises conflict and privilege problems. That separation is why coverage counsel is retained independently of defense counsel and why defense counsel should not be the conduit for coverage-relevant facts.
