Why it Matters?
The defense is most useful against limitations arguments where the defendant's own conduct discouraged timely filing, but it works symmetrically for defendants where a plaintiff's representations led to a changed position. Establishing reasonable reliance is the element that fails most often, since a party represented by counsel is generally held to have had the means of learning the true facts.
